General conditions of purchase

These General Terms and Conditions shall expressly regulate the commercial relations that arise between Cigarte Ibérica S.L. and the users or clients who contract the products offered by this company through the Online Store www.cigarte.com.

These have been drawn up by the current regulations on the matter and specifically, by the provisions of the following legal texts: Law 34/2002, on Information Society Services and Electronic Commerce. Law 7/1998 on General Terms and Conditions. Royal Decree 1906/1999 regulating telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998. Royal Legislative Decree 1/2007 Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws. Law 7/1996 on the Regulation of Retail Trade. Law 59/2003 on Electronic Signature.

Both browsing and purchasing any of the products from the Online Store www.cigarte.com, implies the acceptance as a user, without reservation of any kind, of every one of the following General Conditions of Contract, as well as, where applicable, the Particular or specific Conditions.

The prices of the products are shown with VAT included and any other tax that may be applicable in the national territory.

If Cigarte Ibérica S.L. identifies a manifest error in the price of the products, it will inform the customer, and the latter will have the option of confirming their order at the correct price or canceling it.

The price of the product does not include shipping costs. These costs are the responsibility of the customer and will be added to the total amount of the products selected. The customer will be duly informed at the end of the purchase process and prior to the final confirmation of the order.

Observations

If the photos or characteristics do not correspond to the product, the description of the item prevails. The images will not have contractual value. Prices may be subject to change without prior notice.

Cigarte Ibérica S.L. tries to provide information about the product as accurately as possible. This information is provided by our manufacturers and/or suppliers and/or online information catalogs that work with them. Cigarte Ibérica S.L. is not responsible for the accuracy of the information shown.

Generalities

For all purposes, orders placed in this store are purchases made from Cigarte Ibérica S.L. Our telephone service hours are from 10:00 to 14:00 and from 17:00 to 20:00 from Monday to Friday on business days according to the work calendar of the Community of Madrid.

Unless otherwise stipulated in writing, purchasing Cigarte Ibérica S.L. implies the acceptance by the customer of these conditions. No stipulation made by the customer may differ from those of Cigarte Ibérica S.L. if it has not been expressly accepted in advance and in writing by Cigarte Ibérica S.L.

A purchase is not final until it is accepted by Cigarte Ibérica S.L.

Cigarte Ibérica S.L. reserves the right to accept and cancel any order, being able to return the amount paid by the customer and being exempt from any other obligation.

Method of payment

Products and services will be paid for in advance by credit card, bank transfer or deposit into a bank account.

In order to make a payment by credit or debit card, it is necessary to use a card ISSUED IN SPAIN and on which the secure payment systems "MasterCard SecureCode" or "Verified by VISA" have been activated, as appropriate. If you have any questions about how to activate the secure payment system on your card, please contact your bank.

If you are experiencing problems making a payment by card and wish to change the payment method for your order, please contact our customer service via email (hola@cigarte.com) or by phone (34 91 733 89 98) during business hours.

Shipping

Cigarte Ibérica S.L. will not send any product until the Administration Department has verified that payment has been made.

Delivery will be considered to have been made when the carrier has made the products available to the customer and the customer has signed the delivery receipt document. It is the customer's responsibility to check the products upon receipt and to state any reservations and claims that may be justified in the delivery receipt document.

Cigarte Ibérica S.L. will send the products by the means it deems appropriate to meet its commitments.

Shipping costs

A shipping charge will be applied and will be clearly stated during checkout.

Out of stock

We only sell products in stock and limited series on our portal. However, the synchronization of the website with our warehouse is not instantaneous. In addition, in the period of time between when a customer registers an order on the portal and when we receive and process the proof of payment, a product may be out of stock. Therefore, there may be an isolated case in which we cannot fulfill an order due to lack of stock.

When it is not possible to fulfill a product due to lack of stock, Cigarte Ibérica S.L. will contact the customer to inform them, cancel the order and return their money immediately by bank transfer.

Return policy

If the order arrives in poor condition, it must be noted on the carrier's delivery note. At Cigarte Ibérica S.L. we try to pack the products in such a way that they are perfectly protected. In the case of packaging in poor condition, hit, wet or manipulated, we always advise noting it on the carrier's delivery note so that there is a record. The merchandise may be in perfect condition even with damaged packaging, but to resolve conflicts it is always preferable to leave a record from the moment of delivery. In any case, contact us as soon as possible and we will try to find a solution to the problem.

You can return any item purchased at www.cigarte.com during the following 14 calendar days after purchase, whether the cause is a factory defect or error in shipping (receiving one product for another) or for personal reasons such as you changing your mind regarding your purchase.

In the first case, the procedures are free of charge for you.

In the second case, you must take care of the required shipping costs.

Requirements

  • To return an item, we need its original packaging and to verify that it has not been tampered with or opened. In the event of any type of external or internal manipulation of the product, it cannot be returned or exchanged, except for a factory defect.

You will have the option of:

  • Receiving a refund for the product, using the same payment method you used, provided that the return requirements and deadlines are met. Shipping costs cannot be refunded, except for a product defect.
  • Or you can exchange it for the same product (in case of error or defect) or a product of the same price, as well as for any other product you wish, paying the difference.

Return process for online purchases

  • If the reason for the return is due to a product defect or a shipping error (one product was sent after ordering another), after verifying all the details, we will send a carrier to collect your package.

Once the return package is received, it will be verified and the return will be approved. After verification and approval, another unit of the same item will be sent to you, or another product of your choice (of the same price or paying the difference) or the amount of the product will be refunded to you by the same method in which you paid for your purchase (credit card, PayPal or transfer).

After verification, you will receive a confirmation email indicating that the amount will be credited to your account in a few days or that the new product will be received.

  • If the reason for the return is due to a change of mind or similar: you only have to contact us by email or telephone, inform us of your intention to return, send us the product in secure and certified packaging (if the product arrives in poor condition from origin, in poor condition due to transport or is lost in transit, we will not be able to proceed with its return). After checking that everything is correct, we will proceed as soon as possible to refund it through the same means in which it was paid.

Deadlines

The deadline for making a return is 14 days from the date of purchase, both in-store and online.

Cigarte Ibérica S.L. reserves the right to reject returns that are communicated or sent outside the established deadline, or products that are not in the same condition as when they were received.

Limitation of liability

The information provided on this portal by Cigarte Ibérica S.L. is for informational purposes only and therefore Cigarte Ibérica S.L. does not accept any responsibility for its content (such as the suitability of a product for a particular purpose). Likewise, Cigarte Ibérica S.L. does not guarantee that the information provided on this portal is complete or current.

Except in cases where expressly indicated, neither Cigarte Ibérica S.L. nor any of its directors, employees or representatives will be liable for any possible damages arising from the use of this site. Specifically, they will not be liable for any possible damages caused to persons and/or things, or for the total or partial loss of data and information, or for expenses and/or loss of profits that may occur from the use of the products marketed by Cigarte Ibérica S.L.

Cigarte Ibérica S.L. is not responsible for the content of other web pages linked to this site. The risks arising from consulting such pages correspond exclusively to the client who must be governed by the terms and conditions of use thereof.

Force Majeure

The parties shall not be liable for any failure due to force majeure. Fulfillment of the obligation shall be delayed until the cessation of the event of force majeure.

Nullity and ineffectiveness of clauses

If any clause of these General Conditions of navigation and use of this WEBSITE is declared totally or partially null or ineffective, it will only affect said provision or part of it that is null or ineffective, with the rest of the general conditions remaining in force and such provision or the part of it that is affected being considered as not included, unless, being essential to these general conditions, it would affect them in an integral manner.

Applicable law and jurisdiction

These General Conditions of use and navigation, as well as any relationship between the user and Cigarte Ibérica S.L. shall be governed by Spanish law. For any dispute arising from the existence or content of these General Conditions or the relationship between the user and Cigarte Ibérica S.L., both parties, expressly waiving any other jurisdiction that may apply to them, submit to the exclusive jurisdiction and competence of the Courts and Tribunals of Madrid.
